New Signal from the CFTC to Crypto Exchanges: Leveraged Trading to Be Regulated if Congress Stalls

CFTC Chairman Mike Selig announced that if the CLARITY Act stalls in Congress, they will draft new rules for crypto markets using their existing authorities.

U.S. Commodity Futures Trading Commission (CFTC) Chairman Mike Selig explained the conditions of the plan at the first Innovation Advisory Committee meeting held on August 21. According to Wu Blockchain, Selig stated that if the CLARITY Act does not progress due to Democratic opposition, the agency will use its existing legal authority to establish a regulatory framework for crypto asset markets. The Chairman also instructed his staff to work on a new status that could be applied to exchanges.

However, this plan is not yet in effect. Rules have not yet been proposed, and no crypto exchange has been transitioned to this status. The CLARITY Act is on the Congressional agenda as a bill aiming to determine which agencies and rules will oversee crypto asset markets in the U.S. If the bill fails to move forward, the CFTC stated it would move quickly to propose new rules.

CFTC is examining a special status for crypto exchanges

The model under review is based on a specific U.S. derivative exchange status called a “crypto asset DCM.” This status could allow exchanges to offer leveraged or collateralized transactions under CFTC oversight. Leveraged trading means an investor opens a position exceeding the amount of money they deposited. Collateral refers to the security provided for this transaction.

The plan could cover unregistered crypto exchanges as well as those already registered. If the legislative deadlock continues and the framework is implemented, global platforms may change their products to comply with U.S. rules. This situation could also indirectly affect the leverage options accessible to Turkish users. At this stage, Selig’s statement is not a definitive timeline or an effective rule, but rather an alternative regulatory plan dependent on the Congressional process.
