While the stalling of the Clarity Act in the U.S. Senate is a major blow to the crypto sector, alternative plans launched by agencies like the SEC and CFTC using their existing authorities are keeping the ecosystem’s progress moving forward.
The Clarity Act, which was expected to clarify whether crypto assets are securities or commodities, has been dragged into uncertainty due to debates such as illicit finance and stablecoin yields. Although this situation limits the CFTC‘s oversight authority over commodity markets, regulatory agencies have not remained idle and have begun charting their own roadmaps. Until new legislation is passed by Congress, agencies are expected to guide the sector using their current powers.
The SEC is preparing to launch a revolutionary sandbox—a controlled testing environment—for tokenized securities in the coming weeks. Additionally, the “Regulation Crypto” rule, which would facilitate fundraising for new projects and ease the oversight burden, is also on the agenda. While agencies attempt to pave the way for the sector through guidelines on areas like mining, meme coins, and reward programs, they are also working on a comprehensive taxonomy regarding how assets should be classified.

While banking authorities are rapidly issuing licenses to crypto companies, the Fed is working on payment systems that would eliminate intermediaries. However, SEC Chairman Paul Atkins emphasizes that congressional legal authority is essential for permanent and future-proof regulation. Following the 2022 crash, the sector is deepening institutional adoption while preserving the gains achieved through the GENIUS Act.
Political uncertainties may keep institutional investors on the sidelines for a while longer, but current taxonomy studies and regulatory guidelines indicate that the market has entered an irreversible path. Even if the Clarity Act does not pass this year, the concrete steps taken by agencies secure the functioning of the crypto world. Industry representatives believe that even if a legal vacuum exists, current regulations will increase competitiveness.
