Misled Investors With a “Special Algorithm” Promise: Ordered to Pay More Than $30 Million

Two people who misled cryptocurrency and precious metals investors through Fundsz in the U.S. have been ordered to pay more than $30 million, while another defendant in the case has been permanently barred from trading.

According to an announcement by the U.S. Commodity Futures Trading Commission (CFTC), the U.S. District Court for the Middle District of Florida ruled against Brian Early and Alisha Ann Kingrey. The court found that the pair made false statements about Fundsz’s expected profits, past trading performance, and the risk of losses to investors.

Early and Kingrey, who were members of Fundsz’s board of directors, also moderated the platform’s Telegram group. Investors were told that their money would be managed using a special algorithm and could later be withdrawn with interest. The court concluded that these promises were also false.

They tried to walk back their promises after learning of the investigation

According to the court’s findings, the pair began backing away from their profitability claims after learning they were under investigation by the CFTC. During the same period, they tried to erase Fundsz’s social media presence.

The ruling against Early and Kingrey was a “default judgment,” issued after the defendants failed to respond to the lawsuit. The payment obligations imposed on the pair totaled more than $30 million.

Other defendants also face obligations under settlement agreements

On the same day, the court also approved settlement orders concerning Rene Larralde and Juan Pablo Valcarce, who were named in the case. After Larralde died in 2023, Rachel Larralde, who was substituted for him in the case, was ordered to transfer possession and control of the Larralde residence in its current condition.

Valcarce was permanently barred from conducting cryptocurrency or precious metals transactions on his own behalf. He was also barred from violating CFTC rules again.
