SEC Chairman Atkins’ Critical Move for Crypto: Rules May Arrive Without Waiting for Congress

U.S. Securities and Exchange Commission (SEC) Chairman Paul Atkins announced that the agency is ready to establish cryptocurrency market rules under its own authority if Congress fails to pass the CLARITY Act.

SEC Chairman Paul Atkins shared a critical message for the future of the cryptocurrency sector in an interview with CNBC. Stating that the agency is “ready, willing, and able” to create crypto market rules within its jurisdiction, Atkins outlined an alternative roadmap against a potential bottleneck in the legislative process. This statement represents a high-level confirmation of an administrative solution for the regulation of crypto assets in the US.

This important move comes at a time when the fate of the CLARITY Act, which aims to put crypto assets on a legal footing in the US, is being discussed. The bill in question crossed a significant threshold on May 14, passing the Senate Banking Committee with a vote of 15 to 9. However, because the bill passed by the committee has not yet been brought to a vote on the Senate floor, the legislative process remains uncertain.

Legislative and Administrative Options in Crypto Regulation

Atkins prioritizes a law passed by Congress because it offers a more permanent framework that is more resilient to changes in administration. However, the slowness of the legislature deepens the uncertainty in the cryptocurrency market. At this point, the SEC Chairman provides a kind of assurance to the market by stating that the agency could take the initiative and implement its own regulations.

While rules determined through administrative means can be put into effect faster than the legislative process, they exhibit a structure that is more sensitive to political changes. Atkins’ move shows that cryptocurrency regulations in the US may not depend solely on congressional decisions. As a result, if Congress remains silent, the SEC is expected to shape its oversight of the market with rules it determines itself.
