Crypto Tax Bill Advances in US: Will the CLARITY Act Return for Market Rules?

Kevin O’Leary stated that the CLARITY Act, which failed to advance in the Senate, could return to the agenda next year.

Shark Tank host and investor Kevin O’Leary argued that the CLARITY Act did not end with its failed vote in the Senate. Speaking at the Avalanche Summit held in New York, O’Leary noted that the bill could be revisited in the first quarter of next year.

The bill received only 49 of the 60 votes required to advance, meaning the CLARITY Act cannot move forward in the Senate at this stage. O’Leary mentioned that he already viewed the bill’s chances of advancing as “zero” prior to the vote.

Tax bill advances, market rules remain on hold

The House Ways and Means Committee, meanwhile, advanced the Digital Asset Tax Certainty Act this week. The bill aims to establish tax rules for staking, mining, small crypto transactions, and broker obligations.

This move shows that the US Congress is making progress on regulations regarding how crypto activities will be taxed, though it has yet to reach the same point on market rules that will determine the sector’s overall operation.

The CLARITY Act, on the other hand, aims to clarify the roles of the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) in crypto markets within a broader federal framework.

O’Leary said that as Congress moves toward collecting taxes from crypto activities, the need for policies to manage these activities will increase. “When you start taxing, you have to have policy,” said the investor, arguing that it is inevitable for the CLARITY Act to return to the agenda at some point.

According to O’Leary’s prediction, the issue could be revisited in the first or second quarter following the midterms. Stating that this expectation is independent of which party holds the majority in Congress, the investor expressed that regulations regarding market structure will gain renewed momentum following the tax move.
