Historic SEC Move in Crypto World: Critical Date Announced for New Regulation
The U.S. Securities and Exchange Commission (SEC) is launching the official process for the “Reg Crypto” regulation, which will allow cryptocurrency projects to issue assets within a legal framework.
Regarding the long-awaited regulatory clarity in the cryptocurrency market, the SEC is preparing to make a historic move. The agency has officially added a new set of rules called “Reg Crypto” to its agenda, which will enable digital assets to be launched on a legal basis. This regulation, which is among SEC Chairman Paul Atkins‘ priority goals, aims to resolve uncertainties in the sector and provide companies with a clear roadmap.
The SEC will open this new proposal for public comment during a meeting to be held on August 14. This move, following the failure of the Digital Asset Market Clarity Act to be put to a vote in the Senate, demonstrates the agency’s desire to establish its own rules. TD Cowen analyst Jaret Seiberg described this step as the first major formal step toward providing regulatory certainty for crypto assets. The Commission will detail these rules that will shape the future of the industry.
New Fundraising Opportunity for Crypto Projects
The proposal offers a roadmap that will allow crypto companies to proceed without being hindered by SEC registration requirements while raising capital for their projects. Additionally, an “exit path” is expected to be defined so that companies can leave the agency’s oversight once projects reach a certain maturity and management is no longer centralized. This could provide growth opportunities for startups without being crushed under legal obligations.
For the Reg Crypto regulation to become law, a two or three-month public comment process will first be implemented. The text will then be reshaped based on the feedback received.
Unlike staff statements, regulations created through the official rulemaking process will be much harder to reverse in the future. This move by the SEC is also proceeding in alignment with joint classification efforts conducted with the Commodity Futures Trading Commission (CFTC) and the approach to tokenized securities. This step by the agency will directly impact the U.S. crypto industry’s position in global competition.
