September 15th 60-Vote Test for CLARITY Act in the US: Will the Process Halt Even if the Bill Fails?
Crypto regulation in the US may progress in certain areas even if the CLARITY Act fails to pass the 60-vote test on September 15th.
Coinbase CEO Brian Armstrong said that the CLARITY Act is approaching the necessary support in the Senate. The critical stage for the bill will be the Senate vote expected on September 15th, which requires 60 votes for discussions to begin.
According to Wu Blockchain, Armstrong stated that remaining disagreements are largely centered around ethics provisions. He said that if the bill is passed, it could drive more institutional capital into the US crypto sector and support tokenized equity products.
Regulation may progress even without the CLARITY Act
Grayscale Head of Research Zach Pandl argued that regulatory clarity in the crypto sector is advancing even without legislation. Pandl stated that developments are occurring particularly in the areas of stablecoins, token issuance, tokenized securities, and regulated perpetual futures.
This approach implies that while the CLARITY Act could provide a comprehensive federal framework, regulatory agencies may move forward with their own steps in some areas. According to both figures, even if the CLARITY Act does not become law in 2026, the SEC and CFTC could offer a more distinct framework for the industry through new rules.
However, a Congressional act remains important for a comprehensive and permanent SEC-CFTC jurisdictional split. The September 15th vote will test the chance of progress in the Senate before whether the bill will be passed.
